Terms & Conditions

For the purposes of this agreement, ‘goods’ shall mean the items (including any fixings) hired out by the Owner to the Hirer. ‘Hirer’ means any person, company, corporation or agency, or its representative who shall hire goods from or engage the services of the Owner. ‘Owner’ means Wedding Wool, its employees or agents.

KEY HIRE TERMS

The Hirer must:

  • accept responsibility for the goods hired from the time of delivery until collection or by return to the Owner

  • be responsible for checking the order is correct on delivery

  • ensure the goods are not altered, tampered with, damaged, moved or repaired without the Owner’s written consent, except for the purpose of returning the goods to the Owner’s premises or moving the goods out of wet weather, if arranged

  • use the goods only for the purpose and capacity for which they were provided - in this case, as decoration

  • ensure the wool is not removed from the bale

  • assume the risk of and indemnify and hold the Owner harmless from and against any and all property damage and personal injury resulting from hire of the goods

  • ensure all goods are returned or are readily accessible for collection by the Owner.

The goods supplied for hire remain at all times the property of the Owner.

The period of hire of the goods shall commence on the date on which you take delivery of the goods to the address nominated by you.

Wedding Wool will endeavour to deliver and collect the goods at the times agreed with the Hirer but will not under any circumstances be liable for any delay in delivery or collection or for failure to deliver or collect.

In the event that the goods are damaged in circumstances where a claim can be made upon insurance, then the Hirer must report the damage to Wedding Wool immediately upon the Hirer becoming aware of such damage and provide all necessary co-operation to Wedding Wool and the insurer in respect of any claim.

The Hirer hereby releases the Owner from, and agrees to indemnify the Owner in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person, death, loss of income or damage caused to the Hirer or its property arising directly or indirectly out of the hire or use of the goods by the Hirer.

PAYMENT

The Hirer must pay the hire fees specified in Wedding Wool’s quote for the duration of the hire period and in accordance with this agreement.

A 30% deposit payment is due within 7 days of the invoice date. The booking will not be confirmed until this payment is received. The deposit payment is non-refundable.

The final balance is due no later than 4 weeks prior to the hire day. As items and our time have both been set aside no refunds will be issued. If an order is placed less than 4 weeks prior to the hire date the full payment is required to confirm the booking.

Should Wedding Wool’s prices increase at any time, changes will not affect a Hirer who has paid a deposit for an agreed amount.

ADDITIONAL CHARGES

The Hirer accepts full responsibility to compensate the Owner for the value of the goods or parts thereof which may be lost, damaged or stolen from the time of commencement of the hire or delivery, whichever is earlier, until the goods are returned to the Owner’s premises or collected by the Owner.

If hire items are not returned by the date specified for DIY bookings or if they are not made available to Wedding Wool to be picked up on the hire day or the day after as specified, then late charges will be applied at a daily rate of 25% of the original hire charge.

A minimum 4 hour window is required for delivery and collection. Less than 4 hours will have an additional fee of $25. Less than 2 hours will have an additional fee of $50.

Late night bump outs or deliveries requested prior to 8am will incur a $100 surcharge.

If no-one is available at the time organised for delivery and collection at the venue, and access is not available then an hourly rate of $30 will be charged until access is gained.

CANCELLATIONS

If the Owner is unable to provide goods to the Hirer for reasons outside its control then the Owner may make changes to the order or cancel the order even if full payment has been received. In these circumstances the Hirer will receive a full refund of payments made to date.

The Owner reserves the right to cancel any orders on the basis of unsatisfactory work conditions including the weather or if the Owner feels that for any reason the goods may be at risk of being stolen or damaged.

If the Owner is unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation, acts of god, inclement weather, strikes, lockouts, fires, riots, civil commotion or unrest, interference by civil or military authorities or act of war) the Owner may give written notice to that effect to the Hirer, giving full particulars of such force majeure in which case the obligations of the Owner under these terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. The Owner shall not be liable for any loss or damage suffered by the Hirer as a result of any delays caused by such force majeure events.

We are happy to reschedule if the booking is affected by a Government-imposed COVID-19 lockdown providing we have not yet delivered the goods, otherwise normal cancellation terms will apply.

TERMINATION

Without affecting any other rights Wedding Wool may have, Wedding Wool may terminate these terms at any time without liability to the Hirer if Hirer breaches these terms or fails to pay any amount when due.

ACCEPTANCE OF TERMS AND CONDITIONS

The Hirer is deemed to have accepted these terms and conditions once the deposit payment is made.
